The California Fair Employment and Housing Act has been amended again. Both the DFEH and the EEOC have been given new marching orders as to where they should focus their resources. Moreover, the economy has not improved, and there are still legions of frustrated former employees unsuccessfully looking for employment as their financial resources deplete. The confluence of these trends has led to a significant increase in the filing of lawsuits by fired and laid off employees and that trend does not seem likely to abate soon. Jury pools are increasingly being made up of a large number of similarly-situated peers, thus it is not difficult to see why the odds for plaintiffs winning more cases are increasing.
