This months speaker: The Labor Commissioner's Office and its Mission in California Wage Law Enforcement
The Division of Labor Standards Enforcement commonly known as the "Labor Commissioner's Office" is primarily responsible for the enforcement of the state's minimum labor standards. The minimum labor standards include the payment of the state's minimum wage, payment of overtime, recordkeeping requirements, rest and meal period requirements and other conditions of employment.
In addition, the Labor Commissioner's office enforces the state's mandatory workers' compensation insurance requirement, child labor laws, wage deduction statement requirement and unlicensed contractor requirements.
However, the largest program administered by the Labor Commissioner is the state's wage payment law. An employee who is not paid his/her wages in accordance with the state's requirements may file a claim with the Labor Commissioner. The claim is processed through an informal settlement procedure and may result in an administrative hearing where a final determination of the Labor Commissioner results.
About our presenter …Linda Aguilar, Senior Deputy Labor Commissioner.
Linda Aguilar in her capacity as Senior Deputy Labor Commissioner at the Division of Labor Standards Enforcement manages the San Diego Wage Adjudication Unit which adjudicates wage claims on the behalf of workers who file claims for nonpayment of wages. Linda Aguilar began her career of 21 years in labor law with State Compensation Insurance Fund, specializing in worker’s compensation insurance and later transferred to the Labor Commissioner’s office focusing on the enforcement of California’s wage and hour labor laws. Linda Aguilar is a graduate from Loyola Marymount University.
